Terms of service

1. About these terms

These terms govern the use of Pandora Search (the «service»), a web tool for link analysis with open sources operated by a duly incorporated company («we»), whose identification details are provided on legitimate request to info@pandorasearch.com, as the legal notice explains. By creating an account or using the service you accept these terms, the privacy policy and the acceptable use policy, which form part of them. If you use the service on behalf of an organisation, you accept them on its behalf and confirm that you are authorised to do so.

2. The service

Pandora Search queries publicly available sources (public APIs, open data, official registries and open-source tools) about the data points you enter, and presents the results as a graph, a map, a timeline, a dossier and a table, with the source of each finding and a log of each query.

Results are leads to verify, not established facts: sources can be incomplete, outdated or wrong, and the same identifier can belong to different people. You must check them before relying on them. Many sources depend on third parties that may change, limit or withdraw their service at any time; we do not guarantee that a particular source, transform or result will be available.

3. Accounts

  • You sign in with a link or a code sent to your email address, or with Google. Use an email address you control and keep access to it secure: anyone with access to your inbox can sign in to your account.
  • You must be at least 18 years old and able to enter into this contract.
  • Each account is for one person. Do not share it or let others use it. You are responsible for the activity carried out from your account.

4. Your investigations

Each case must have a declared, lawful purpose, which is recorded in the audit log together with every query. You must use the service in accordance with the acceptable use policy and the law, including data protection law.

When you investigate a natural person you are the controller of that processing and must have a valid legal basis for it. We process that data on your behalf, as a processor, under the data processing terms, as described in the privacy policy.

5. Credits

  • The service is used with credits. Each transform consumes the credits shown on the pricing page when it runs (currently 1 for an open source, 5 for a heavy transform and a specific amount for each premium source). Links that you open by hand consume none.
  • Plan credits are added at the start of each billing period and do not carry over to the next one. Credits from packs and the credits granted at sign-up are used after the plan credits and expire 12 months after they are granted.
  • The 3 trial searches of a free account are granted once per person, and what they find is shown masked until a plan is chosen. Opening several accounts to obtain them again is not allowed.
  • If a transform fails for reasons attributable to us without returning any result, its credits are returned to your balance.
  • Credits have no monetary value: they cannot be exchanged for money, transferred or resold, and they are not refunded when an account is closed, except where the law requires it.
  • Some sources only run with your own API key, because their terms do not allow resale; with it they consume 1 credit. You are responsible for complying with the terms of the provider of each key you add.

6. Plans, prices and payment

  • The plans (ANALYST, INVESTIGATOR and AGENCY) are offered monthly, annually or as a single lifetime payment, at the prices shown on the pricing page in your currency.
  • Payments are processed by Freemius, Inc., which acts as merchant of record: Freemius sells you the subscription or the credit pack, collects the payment, issues the receipt and charges the taxes that apply. Your purchase is also subject to Freemius's terms, which you accept at checkout. We never receive or store your card details.
  • The first-month price of a monthly plan applies only to its first payment and only to accounts that have never had a plan.
  • Monthly and annual plans renew automatically at the end of each period, at the price in force, until you cancel. The lifetime plan is a single payment, without renewals, that keeps the plan and its monthly credits for as long as we operate the service.
  • Credit packs are single payments.
  • We may change prices. A change does not affect a period already paid; if it affects your renewal, we will tell you by email at least 30 days in advance, and you may cancel before it applies.

7. Cancellation

You can cancel a subscription at any time from your account page. Cancellation takes effect at the end of the period already paid: the plan stays active until then and does not renew. Deleting your account also cancels your subscription.

8. Refunds and right of withdrawal

Plans and credit packs are digital services supplied at once. If you are a consumer in the European Union or the United Kingdom, you normally have 14 days to withdraw from a purchase. For digital services and content, that right ends when the supply starts with your express consent. In Freemius's checkout you are asked to request immediate access and to acknowledge that you lose the right of withdrawal once access starts; by doing so and paying, you agree to that. Refunds are governed by the terms of sale of Freemius, the merchant of record, which you accept at checkout. To ask about one, write to info@pandorasearch.com with the email address you paid with. Nothing in these terms limits the rights that consumer law gives you.

9. Suspension and termination

  • We may suspend or close an account, with or without notice depending on the seriousness of the case, if it breaches these terms or the acceptable use policy; if we receive a credible report of misuse or a request from a competent authority; if a payment is reversed or fraudulent; or if its use puts the service, other users or third parties at risk. Where possible we will explain the reason and let you respond.
  • If we close an account for a breach of these terms, no refund is due for the period paid or the remaining credits, except where the law requires it. If we close it for any other reason, we will refund the proportional part of the period paid and of the unused pack credits.
  • You can delete your account at any time from your account page; this deletes your cases and cancels your subscription.
  • If we discontinue the service, we will give at least 90 days' notice by email and refund the proportional part of the periods paid. Lifetime plans carry a 3-year guarantee: we undertake to offer the service for at least the 3 years following each lifetime purchase and, if we stopped within that period, we would refund the pro-rata share of the price that corresponds to the time left until the 3 years are up (for example, two thirds of what was paid if we stopped at the end of the first year). After those 3 years the guarantee is fulfilled and no refund is due on this ground.

10. Intellectual property

The service, its software, design and content belong to Pandora Search or its licensors; open-source components and data sources are used under their licences, listed on the attributions page. We grant you a personal, non-exclusive and non-transferable right to use the service while your account is active. The data you enter and the results of your cases are yours; you allow us to store and process them only to provide the service. You may not copy, resell or reverse-engineer the service, automate access to it beyond its normal use, or use it to build a competing database.

11. Liability

  • The service is provided «as is» and «as available». We take reasonable care to keep it running and secure, but we do not guarantee that it will be uninterrupted or free of errors, or that the results will be complete or accurate.
  • You are responsible for how you use the results, for the decisions you make with them and for the processing of personal data you carry out.
  • To the extent permitted by law, our total liability for any claim related to the service is limited to the amounts you paid in the 12 months before the event that gave rise to it, and we are not liable for indirect damages, loss of profit or loss of data. Nothing in these terms limits liability for wilful misconduct or gross negligence, for death or personal injury, or any liability that the law does not allow to be limited, including the rights of consumers.
  • You will hold us harmless from third-party claims arising from your use of the service in breach of these terms or the law.

12. Changes to these terms

We may update these terms. If a change is material, we will tell you by email at least 30 days before it applies; if you do not agree, you can cancel and delete your account before then. Continuing to use the service after that date means you accept the new terms.

13. Law and jurisdiction

These terms are governed by Spanish law. Any dispute will be submitted to the courts of your place of residence when you are a consumer and the law so requires and, in all other cases, to the courts of Spain.
